IMPORTANT: Please read these Terms of Service carefully before using Assymetrix. By accessing or using our platform or API, you agree to be bound by these terms.

3. Eligibility
To use our Services, you must be at least 18 years of age and legally capable of entering into binding contracts in your jurisdiction. By using our Services, you represent and warrant that you meet these eligibility requirements.
You are responsible for ensuring that your use of our Services complies with all laws and regulations applicable to you in your jurisdiction. Assymetrix Services may not be available in all regions.
Certain subscription tiers (such as Academic tiers) may have additional eligibility requirements as described in Section 11.
4. Account Registration
Certain features of our Services, including API access, require you to create an account. When registering, you agree to:
Provide accurate, current, and complete information
Maintain and promptly update your account information
Keep your login credentials and API keys secure and confidential
Notify us immediately of any unauthorized access to your account or API keys
Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for fraudulent, abusive, or illegal purposes.
5. Subscription Plans and Payments
Assymetrix offers both free and paid subscription tiers. Current subscription tiers, their features, and pricing are published at data.assymetrix.com/pricing (or such other URL as we may designate). By subscribing to a paid plan, you agree to pay all applicable fees as described at the time of purchase.
5.1 Billing
Subscription fees are billed in advance on a monthly or annual basis, depending on your selected plan.
5.2 Automatic Renewal
Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
5.3 Price and Feature Changes
We may modify subscription pricing or tier features with 30 days' notice. Existing subscribers will retain their current tier benefits through the end of their paid subscription period. Renewal will be at the then-current terms unless otherwise communicated.
5.4 Refunds
Subscription fees are generally non-refundable, except as required by applicable law or at our sole discretion.
5.5 Payment Processing
All payments are processed through third-party payment processors. Your use of payment services is subject to their respective terms and privacy policies.
6. Rewards Program
Assymetrix may offer a rewards program involving points, credits, or other incentives ("Rewards"). By participating in the Rewards program, you acknowledge and agree that:
Rewards are provided at our sole discretion and may be modified, suspended, or terminated at any time
Rewards have no cash value and cannot be exchanged for fiat currency through Assymetrix
Reward features, utility, and distribution are subject to change based on platform development
You are solely responsible for understanding and complying with any tax obligations related to Rewards received
7. Acceptable Use Policy
You agree not to use our Services to:
Violate any applicable laws, regulations, or third-party rights
Engage in market manipulation, fraud, or deceptive practices
Scrape, crawl, or use automated means to access our Services beyond authorized API access
Circumvent rate limits, authentication mechanisms, or access controls
Attempt to gain unauthorized access to our systems or other users' accounts
Interfere with or disrupt the integrity or performance of our Services
Reverse engineer, decompile, or attempt to extract source code from our platform
Use our data to create a competing data aggregation or API service
Resell, redistribute, or commercially exploit raw API data as a standalone product
Transmit malware, viruses, or other harmful code
Exceed your subscription tier's authorized usage
8. Intellectual Property Rights
All content, features, and functionality of our Services—including but not limited to text, graphics, logos, icons, images, software, data compilations, analytics, and the canonical data schema—are the exclusive property of Assymetrix or our licensors and are protected by intellectual property laws.
8.1 License Grant
Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services in accordance with your subscription tier. For users of the Assymetrix Data API, the specific license terms in Sections 9-12 apply.
8.2 Commercial Use
Paid subscription tiers permit commercial use of our Services, including building and monetizing applications that incorporate our data. The Free tier permits commercial use subject to its feature limitations. Tiers designated as "Academic" or "Non-Commercial" are restricted to non-commercial use only as described in Section 11.
8.3 Restrictions
This license does not include the right to:
Reproduce, distribute, or create derivative works from our proprietary content without express written permission
Resell, sublicense, or redistribute raw API data as a standalone data product
Create a competing data aggregation, normalization, or API service
Remove or obscure any attribution, source information, or proprietary notices
9. Data API Access and Authentication
This section and Sections 10-12 apply specifically to access and use of the Assymetrix Data API ("API"). These terms supplement, and do not replace, the general Terms above.
9.1 API Keys
Access to the API requires authentication via API keys issued by Assymetrix. API keys are confidential credentials assigned to your account. You are solely responsible for maintaining the security of your API keys and for all activity that occurs under them.
9.2 Key Security
You must not share, publish, or expose your API keys in public repositories, client-side code, or any publicly accessible location. If you believe an API key has been compromised, you must notify us immediately and rotate the key through your account dashboard.
9.3 Revocation
We may revoke API keys immediately and without notice for violation of these Terms, suspected abuse, non-payment, or security concerns.
9.4 Key Limits
The number of API keys available to you depends on your subscription tier, as specified on our pricing page.
10. Rate Limits and Usage
10.1 Rate Limits
Each subscription tier includes specific rate limits governing the frequency of API requests. Rate limits are enforced automatically. Requests exceeding your tier's rate limit may receive throttled responses (HTTP 429) or be temporarily blocked.
10.2 Tier-Based Access
Rate limits, available endpoints, and feature access vary by subscription tier. Current tier specifications are published on our pricing page and may be updated from time to time. Your access is governed by the tier specifications in effect at the time of your subscription period.
10.3 Fair Use
All tiers are subject to fair use policies. Intentional circumvention of rate limits—including but not limited to rotating API keys across multiple accounts, distributing requests to avoid limits, or automated retry flooding—is prohibited and may result in immediate suspension.
10.4 Overages
Unless otherwise specified for your tier, requests exceeding rate limits will be rejected rather than billed as overages.
11. Data License and Restrictions
11.1 License Grant
Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to:
Access data through the Assymetrix API
Integrate API data into your applications and services
Display API data to your end users
This license is conditional on continued compliance with these Terms and your subscription tier's terms.
11.2 Restrictions
Regardless of your subscription tier, you may NOT:
Resell, sublicense, or redistribute raw API data as a standalone data product or feed
Create a competing data aggregation, normalization, or API service using our data
Provide API pass-through access that re-exposes our API as your own service
Systematically download, cache, or store data for purposes of creating a mirror or archive of our database (except as permitted for your tier's backup/caching allowances)
Use data to train machine learning models intended for redistribution or commercial sale without prior written permission
Remove, obscure, or alter any attribution, source information, or proprietary notices
11.3 Permitted Caching
You may cache API responses for reasonable operational purposes (e.g., reducing redundant requests, improving application performance). Unless your tier specifies otherwise, cached data should not be retained for longer than 30 days.
11.4 Attribution
When publicly displaying data obtained through the Assymetrix API—including in applications, dashboards, publications, or media—you must include attribution such as "Data provided by Assymetrix" or display the Assymetrix logo where technically feasible. Attribution requirements may be waived for Enterprise tier subscribers by written agreement.
11.5 Academic and Non-Commercial Licenses
Tiers designated as "Academic" or "Non-Commercial" are available only to students, faculty, and researchers at accredited educational or research institutions. We may require documentation proving eligible affiliation.
Academic/Non-Commercial tiers may be used solely for:
Academic research and scholarly publications
Coursework, theses, and educational projects
Non-commercial research and analysis
Academic/Non-Commercial tiers may NOT be used for:
Commercial applications, products, or services
Trading, investment, or revenue-generating activities
Consulting, contract research, or paid advisory services
Your Academic/Non-Commercial license terminates automatically if you cease to meet the eligibility requirements.
11.6 Bulk Data Export
Bulk data export capabilities (including Parquet, CSV, and other formats) are available only to subscription tiers that explicitly include this feature. Bulk exported data may be stored on your own infrastructure for internal analysis but may not be redistributed, resold, sublicensed, or made publicly available. Upon termination of your subscription, you must delete all bulk exported data within 30 days.
12. Third-Party Data Sources
12.1 Data Provenance
Each subscription tier includes specific rate limits governing the frequency of API requests. Rate limits are enforced automatically. Requests exceeding your tier's rate limit may receive throttled responses (HTTP 429) or be temporarily blocked.
12.2 Third-Party Terms
Data originating from third-party platforms is aggregated by Assymetrix under our agreements with those platforms or from publicly available sources. Your use of such data through our API does not create any direct relationship between you and the third-party platforms.
12.3 Data Accuracy
Third-party data is provided "as is." While Assymetrix normalizes, structures, and enriches this data, we do not independently verify the accuracy, completeness, or timeliness of data originating from third-party sources.
12.4 No Endorsement
Inclusion of a platform's data in the Assymetrix API does not constitute endorsement of that platform, its practices, or the markets it hosts.
13. Service Availability and API Changes
13.1 General Availability
We strive to maintain high availability for our Services and API but do not guarantee specific uptime levels for standard subscription tiers.
13.2 Enterprise SLA
Subscribers to Enterprise tier (or equivalent custom arrangements) may negotiate Service Level Agreements with specific uptime commitments, response time guarantees, and remedies. SLA terms will be documented in a separate agreement.
13.3 Scheduled Maintenance
We may perform scheduled maintenance that temporarily affects service availability. When possible, we will provide advance notice through our status page or direct communication.
13.4 API Versioning
We may release new API versions with additional features, improved functionality, or breaking changes. When we deprecate an API version or endpoint, we will provide at least 90 days' notice before discontinuation, except in cases of security vulnerabilities or legal requirements.
13.5 Breaking Changes
We will provide at least 30 days' notice before implementing breaking changes to stable, production API endpoints. We may add new endpoints, new optional fields, or new features at any time without notice.
14. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by law, Assymetrix disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that:
Our Services will be uninterrupted, secure, or error-free
Data or analytics provided will be accurate, complete, or timely
Any results obtained from using our Services will be reliable
Defects or errors will be corrected
15. No Financial or Investment Advice
Nothing on our platform or in our API data constitutes financial, investment, legal, or tax advice.
All information is provided for educational and informational purposes only. Assymetrix does not recommend, endorse, or advise on any prediction market positions, trades, or strategies.
Any decisions you make based on information obtained through our Services are made at your own risk and discretion. You should consult qualified professionals before making any financial decisions.
Past performance data displayed on our platform is not indicative of future results. Prediction markets involve substantial risk of loss, and you should never risk more than you can afford to lose.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASSYMETRIX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:
Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Trading losses or financial damages of any kind
Damages arising from your use of or inability to use our Services
Any conduct or content of third parties on or related to our Services
Decisions made based on data obtained through our API
In no event shall our total liability exceed the greater of (a) the amount you paid to Assymetrix in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).
17. Indemnification
You agree to indemnify, defend, and hold harmless Assymetrix and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
Your use of our Services or API
Your violation of these Terms
Your violation of any rights of another party
Any content you submit or transmit through our Services
Any applications or services you build using our API
Your end users' use of applications built on our API
18. Suspension and Termination
18.1 Suspension
We may suspend your access to our Services immediately and without prior notice if we reasonably believe:
You are violating these Terms
Your usage poses a security risk
Your account or API keys have been compromised
You have failed to pay applicable fees
Your usage is abusive, fraudulent, or illegal
18.2 Termination by You
You may terminate your account or subscription at any time through your account dashboard. Termination takes effect at the end of your current billing period. No refunds are provided for partial periods.
18.3 Termination by Us
We may terminate your account for cause (violation of Terms, non-payment, illegal activity) immediately, or for convenience with 30 days' notice.
18.4 Effect of Termination
Upon termination:
All API keys associated with your account are immediately revoked
Your license to use our Services and API data terminates
You must cease all use of the API and delete cached data within 30 days
You remain liable for any fees incurred prior to termination
Provisions that by their nature should survive (including Sections 11.2, 11.6, 14, 15, 16, 17, and 20) will survive termination
19. Privacy
Your use of our Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our Services, you consent to our data practices as described in our Privacy Policy.
20. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any dispute arising from these Terms or your use of our Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Assymetrix.
21. Modifications to Services and Terms
We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time without notice.
We may update these Terms from time to time. Material changes will be communicated through our platform, via email, or by posting a notice on our website. Your continued use of our Services after changes become effective constitutes acceptance of the revised Terms.
If you do not agree to any changes, you must stop using our Services.
22. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
23. Entire Agreement
These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference (including any Enterprise SLA), constitute the entire agreement between you and Assymetrix regarding your use of our Services.
